An anonymous reader shares a report: India is set to begin mass-producing electric-vehicle batteries within 18 months, a step hailed as a leap towards industrial self-reliance. Yet the structure of this new industry looks troublingly familiar, echoing a pattern of dependence that has long marked India's economy.

Nowhere is this dependence clearer than in the heft of intellectual property. The portfolios of India's largest battery-makers, Amara Raja and Exide, contain just seven patents combined. This pales in comparison to the industry's giants: China's CATL sits on a hoard of over 43,000 patents, while South Korea's LG Energy Solution possesses some 70,000.

Having largely missed the global lithium-ion boom, India's established lead-acid manufacturers built a business model on licensing technology rather than inventing it. This long-standing habit is now reflected in deals that create deep technological dependency. A 2022 agreement between Exide and China's SVOLT, for example, calls for SVOLT to not only transfer intellectual property but also to oversee plant construction, supply the equipment and integrate the factory into its own Chinese supply chain. Amara Raja's deal with Gotion High-Tech in June 2024 follows a similar template.

WD Escapes Half a Billion in Patent Damages as Judge Trims Award To $1 (theregister.com) 11

Western Digital has succeeded in having the sum it owed from a patent infringement case reduced from $553 million down to just $1 in post-trial motions, when the judge found the plaintiff's claims had shifted during the course of the litigation. From a report: The storage biz was held by a California jury to have infringed on data encryption patents owned by SPEX Technologies Inc in October, relating to several of its self-encrypting hard drive products.

WD was initially told to pay $316 million in damages, but District Judge James Selna ruled the company owed a further $237 million in interest charges earlier this year, bringing the total to more than half a billion dollars. In February, WD was given a week to file a bond or stump up the entire damages payment.
Selna granted Western Digital's post-trial motion to reduce damages, writing that "SPEX's damages theory changed as certain evidence and theories became unavailable" and there was "insufficient evidence from which the Court could determine a reasonable royalty."

Novo Nordisk Loses Canadian Patent Protection For Blockbuster Diabetes Drug Over Unpaid $450 Fee (science.org) 72

Pharmaceutical giant Novo Nordisk forfeited patent protection for semaglutide -- the active ingredient in blockbuster diabetes and weight loss drugs Ozempic and Wegovy -- in Canada after failing to pay a $450 maintenance fee in 2019. The company had paid maintenance fees through 2018 but requested a refund for the 2017 fee, apparently seeking more time to decide whether to continue protecting the patent.

When the 2019 fee came due at $450 with late penalties, Novo never paid despite having a one-year grace period. Canadian patent authorities confirmed the patent "cannot be revived" once lapsed. The oversight is particularly costly given Canada represents the world's second-largest semaglutide market, worth billions annually. Generic drugmaker Sandoz plans to launch a competing version in early 2026, while Novo's U.S. patent protection extends until at least 2032.

Intel Wins Jury Trial Over Patent Licenses In $3 Billion VLSI Fight (reuters.com) 22

A Texas jury ruled that Intel may hold a license to patents owned by VLSI Technology through its agreement with Finjan Inc., both controlled by Fortress Investment Group -- potentially nullifying over $3 billion in previous patent infringement verdicts against Intel. Reuters reports: VLSI has sued Intel in multiple U.S. courts for allegedly infringing several patents covering semiconductor technology. A jury in Waco, Texas awarded VLSI $2.18 billion in their first trial in 2021, which a U.S. appeals court has since overturned and sent back for new proceedings.

An Austin, Texas jury determined that VLSI was entitled to nearly $949 million from Intel in a separate patent infringement trial in 2022. Intel has argued in that case that the verdicts should be thrown out based on a 2012 agreement that gave it a license to patents owned by Finjan and other companies "under common control" with it. U.S. District Judge Alan Albright held the latest jury trial in Austin to determine whether Finjan and VLSI were under the "common control" of Fortress. VLSI said it was not subject to the Finjan agreement, and that the company did not even exist until four years after it was signed.

MIT Asks arXiv To Take Down Preprint Paper On AI and Scientific Discovery 19

MIT has formally requested the withdrawal of a preprint paper on AI and scientific discovery due to serious concerns about the integrity and validity of its data and findings. It didn't provide specific details on what it believes is wrong with the paper. From a post: "Earlier this year, the COD conducted a confidential internal review based upon allegations it received regarding certain aspects of this paper. While student privacy laws and MIT policy prohibit the disclosure of the outcome of this review, we are writing to inform you that MIT has no confidence in the provenance, reliability or validity of the data and has no confidence in the veracity of the research contained in the paper. Based upon this finding, we also believe that the inclusion of this paper in arXiv may violate arXiv's Code of Conduct.

"Our understanding is that only authors of papers appearing on arXiv can submit withdrawal requests. We have directed the author to submit such a request, but to date, the author has not done so. Therefore, in an effort to clarify the research record, MIT respectfully request that the paper be marked as withdrawn from arXiv as soon as possible." Preprints, by definition, have not yet undergone peer review. MIT took this step in light of the publication's prominence in the research conversation and because it was a formal step it could take to mitigate the effects of misconduct. "We are making this information public because we are concerned that, even in its non-published form, the paper is having an impact on discussions and projections about the effects of AI on science. Ensuring an accurate research record is important to MIT. We therefore would like to set the record straight and share our view that at this point the findings reported in this paper should not be relied on in academic or public discussions of these topics."
The paper in question, titled "Artificial Intelligence, Scientific Discovery, and Product Innovation" and authored by Aidan Toner-Rodgers, investigated the effects of introducing an AI-driven materials discovery tool to 1,018 scientists in a U.S. R&D lab. The study reported that AI-assisted researchers discovered 44% more materials, filed 39% more patents, and achieved a 17% increase in product innovation. These gains were primarily attributed to AI automating 57% of idea-generation tasks, allowing top-performing scientists to focus on evaluating AI-generated suggestions effectively. However, the benefits were unevenly distributed; lower-performing scientists saw minimal improvements, and 82% of participants reported decreased job satisfaction due to reduced creativity and skill utilization.

Google has overtaken IBM to become the leader in generative AI-related patents and also leads in the emerging area of agentic AI, according to data from IFI Claims. Axios: In the patents-for-agents U.S. rankings, Google and Nvidia top the list, followed by IBM, Intel and Microsoft, according to an analysis released Thursday.

Globally, Google and Nvidia also led the agentic patents list, but three Chinese universities also make the top 10, highlighting China's place as the chief U.S. rival in the field. In global rankings for generative AI, Google was also the leader -- but six of the top 10 global spots were held by Chinese companies or universities. Microsoft was No. 3, with Nvidia and IBM also in the top 10.

An anonymous reader shared this report from the Verge: This morning, while summarizing an Apple "product blitz" he expects for 2027, Bloomberg's Mark Gurman writes in his Power On newsletter that Apple is planning a "mostly glass, curved iPhone" with no display cutouts for that year, which happens to be the iPhone's 20th anniversary... [T]he closest hints are probably in Apple patents revealed over the years, like one from 2019 that describes a phone encased in glass that "forms a continuous loop" around the device.

Apart from a changing iPhone, Gurman describes what sounds like a big year for Apple. He reiterates past reports that the first foldable iPhone should be out by 2027, and that the company's first smart glasses competitor to Meta Ray-Bans will be along that year. So will those rumored camera-equipped AirPods and Apple Watches, he says. Gurman also suggests that Apple's home robot — a tabletop robot that features "an AI assistant with its own personality" — will come in 2027...

Finally, Gurman writes that by 2027 Apple could finally ship an LLM-powered Siri and may have created new chips for its server-side AI processing.

Earlier this week Bloomberg reported that Apple is also "actively looking at" revamping the Safari web browser on its devices "to focus on AI-powered search engines." (Apple's senior VP of services "noted that searches on Safari dipped for the first time last month, which he attributed to people using AI.")

The Open Invention Network's (OIN) origins are rooted in a turbulent era for open source. In the mid-2000s, Linux faced existential threats from copyright and patent litigation. Besides, the infamous SCO lawsuit and Microsoft's claims that Linux infringed on hundreds of its patents cast a shadow over the ecosystem. Business leaders became worried. While SCO's attacks petered out, patent trolls -- formally known as Patent Assertion Entities (PAEs) -- were increasing their attacks. So, open-source friendly industry giants, including IBM, Novell, Philips, Red Hat, and Sony, formed the Open Invention Network (OIN) to create a bulwark against patent threats targeting Linux and open-source technologies. Founded in 2005, the Open Invention Network (OIN) has evolved into a global community comprising over 4,000 participants, ranging from startups to multinational corporations, collectively holding more than three million patents and patent applications.

At the heart of OIN's legal strategy is a royalty-free cross-license agreement. Members agree not to assert their patents against the Linux System, creating a powerful network effect that shields open-source projects from litigation. As OIN CEO Keith Bergelt explained, this model enables "broad-based participation by ensuring patent risk mitigation in key open-source technologies, thereby facilitating open-source adoption." US's AI Lead Over China Rapidly Shrinking, Stanford Report Says (axios.com) 66

The U.S. is still the global leader in state-of-the-art AI, but China has closed the gap considerably, according to a new report from Stanford. Axios: Institutions based in the U.S. produced 40 AI models of note in 2024, compared with 15 from China and three from Europe, according to the eighth edition of Stanford's Artificial Intelligence Index, released on Monday.

However, the report found that Chinese models have rapidly caught up in quality, noting that Chinese models reached near parity on two key benchmarks after being behind leading U.S. models by double digit percentages a year earlier. Plus, it said, China is now leading the U.S. in AI publications and patents.

Amazon Says Germany Customers Won't Lose Amazon Prime As a Result of Nokia Patent Win 12

A German court has ruled that Amazon's Prime Video service violates a Nokia-owned patent, ordering Amazon to stop streaming in its current form or face fines of 250,000 euros per violation. However, Amazon assured customers in a statement on Friday that there is no risk of losing access to Prime Video because the decision affects only a limited functionality related to casting videos between devices.

"Prime Video will comply with this local judgement and is currently considering next steps. However, there is absolutely no risk at all for customers losing access to Prime Video," Amazon's Prime Video spokesperson told Reuters. Meanwhile, Nokia's chief licensing officer, Arvin Patel, said: "...the innovation ecosystem breaks down if patent holders are not fairly compensated for the use of their technologies, as it becomes much harder for innovators to fund the development of next generation technologies."

The article notes Meta has already added context-aware AI to its Ray-Ban glasses and suggests that within five years Meta might try "selling us superpowers we can't resist". And Google's new AI-powered operating system Android XR hopes to augment our world with seamless context-aware content. But think about where this is going. "[E]ach of us could find ourselves in a new reality where technologies controlled by third parties can selectively alter what we see and hear, while AI-powered voices whisper in our ears with targeted advice and guidance."

And yet " by 2030 the superpowers that these devices give us won't feel optional. After all, not having them could put us at a social and cognitive disadvantage."

The US Patent and Trademark Office Banned Staff From Using Generative AI 33

An anonymous reader shares a report: The US Patent and Trademark Office banned the use of generative artificial intelligence for any purpose last year, citing security concerns with the technology as well as the propensity of some tools to exhibit "bias, unpredictability, and malicious behavior," according to an April 2023 internal guidance memo obtained by WIRED through a public records request. Jamie Holcombe, the chief information officer of the USPTO, wrote that the office is "committed to pursuing innovation within our agency" but are still "working to bring these capabilities to the office in a responsible way."

Paul Fucito, press secretary for the USPTO, clarified to WIRED that employees can use "state-of-the-art generative AI models" at work -- but only inside the agency's internal testing environment. "Innovators from across the USPTO are now using the AI Lab to better understand generative AI's capabilities and limitations and to prototype AI-powered solutions to critical business needs," Fucito wrote in an email.

Open Source Fights Back: 'We Won't Get Patent-Trolled Again' (zdnet.com) 64

ZDNet's Steven Vaughan-Nichols reports: [...] At KubeCon North America 2024 this week, CNCF executive director Priyanka Sharma said in her keynote, "Patent trolls are not contributors or even adopters in our ecosystem. Instead, they prey on cloud-native adopters by abusing the legal system. We are here to tell the world that these patent trolls don't stand a chance because CNCF is uniting the ecosystem to deter them. Like a herd of musk oxen, we will run them off our pasture." CNCF CTO Chris Aniszczyk added: "The reason trolls can make money is that many companies find it too expensive to fight back, so they pay trolls a settlement fee to avoid the even higher cost of litigation. Now, when a whole herd of companies band together like musk oxen to drive a troll off, it changes the cost structure of fighting back. It disrupts their economic model."

How? Jim Zemlin, the Linux Foundation's executive director, said, "We don't negotiate with trolls. Instead, with United Patents, we go to the PTO and crush those patents. We strive to invalidate them by working with developers who have prior art, bringing this to the attention of the USPTO, and killing patents. No negotiation, no settlement. We destroy the very asset that made patent trolls' business work. Together, since we've started this effort, 90% of the time, we've been able to go in there and destroy these patents." "It's time for us to band together," said Joanna Lee, CNCF's VP of strategic programs and legal. "We encourage all organizations in our ecosystem to get involved. Join the fight, enhance your own company's protection, protect your customers, enhance our community defense, and save money on legal expenses."

While getting your company and its legal department involved in the effort to fend off patent trolls is important, developers can also help. CNCF announced the Cloud Native Heroes Challenge, a patent troll bounty program in which cloud-native developers and technologists can earn swag and win prizes. They're asking you to find evidence of preexisting technology -- referred to by patent lawyers as "prior art" -- that can kill off bad patents. This could be open-source documentation (including release notes), published standards or specifications, product manuals, articles, blogs, books, or any publicly available information. All entrants who submit an entry that conforms to the contest rules will receive a free "Cloud Native Hero" t-shirt that can be picked up at any future KubeCon+CloudNativeCon. The winner will also receive a $3,000 cash prize.

In the inaugural contest, the CNCF is seeking information that can be used to invalidate Claim 1 from US Patent US-11695823-B1. This is the major patent asserted by Edge Networking Systems against Kubernetes users. As is often the case with such patents, it's much too broad. This patent describes a network architecture that facilitates secure and flexible programmability between a user device and across a network with full lifecycle management of services and infrastructure applications. That describes pretty much any modern cloud system. If you can find prior art that describes such a system before June 13, 2013, you could be a winner. Some such materials have already been found. This is already listed in the "known references" tab of the contest information page and doesn't qualify. If you care about keeping open-source software easy and cheap to use -- or you believe trolls shouldn't be allowed to take advantage of companies that make or use programs -- you can help. A crucial Senate Committee is on the cusp of voting on two bills that would resurrect some of the most egregious software patents and embolden patent trolls. The Patent Eligibility Restoration Act (PERA), S. 2140, would dismantle vital safeguards that prohibit software patents on overly broad concepts. If passed, courts would be compelled to approve software patents on mundane activities like mobile food ordering or basic online financial transactions. This would unleash a torrent of vague and overbroad software patents, which would be wielded by patent trolls to extort small businesses and individuals.

The EFF is inviting members of the public to contact their Senators.
