John Mooney, an Inventor of the Catalytic Converter, Dies at 90 (nytimes.com) 73

John J. Mooney, an inventor of the catalytic converter, the small and ubiquitous device that makes the engines that power everything from cars to lawn mowers less polluting and more fuel efficient, died on June 16 at his home in Wyckoff, N.J. He was 90. From a report: The cause was complications of a stroke, his daughter Elizabeth Mooney Convery said. Mr. Mooney was a high school graduate working as a clerk at a gas company when his colleagues encouraged him to pursue a college education. After earning a bachelor's degree and two master's degrees, he went on to receive 17 patents during his 43-year career with the Englehard Corporation in Iselin, N.J. (now the Catalyst Division of the German chemical manufacturer BASF). Among them was the three-way catalytic converter, which has been described by the Society of Automotive Engineers as among the 10 most important innovations in the history of the automobile. The Environmental Protection Agency has estimated that tailpipe emissions from the newest passenger cars, sport utility vehicles, trucks and buses generate about 99 percent less smog-producing exhaust and soot than those from the 1970 models did.

Google Sues Sonos in Escalation of Wireless Speakers Fight (bloomberg.com) 12

Google escalated a fight with Sonos over the wireless home-speaker market, filing a lawsuit that alleges patent infringement. From a report: The conflict between the two companies, which had been collaborating on incorporating some Google features in Sonos's speakers, erupted in January when Sonos sued Google for infringing its patents. The speaker maker is facing increased competition from tech giants such as Google and Amazon.com that are expanding into selling Internet-connected home gadgets, including less expensive wireless speakers. "Sonos has made false claims about the companies' shared work and Google's technology in the lawsuits," the Alphabet unit said in a complaint filed Thursday in San Francisco federal court. "While Google rarely sues other companies for patent infringement, it must assert its intellectual property rights here." Sonos, the Santa Barbara-based pioneer of wireless speakers, is using Google's patented technology for search, software, networking, audio processing and digital-media management and streaming, while refusing to pay a license, according to the lawsuit.

Linux Desktop Org GNOME Foundation Settles Lawsuit With Patent Troll (theregister.co.uk) 29

The GNOME Foundation has settled a US lawsuit brought against it by Rothschild Patent Imaging, complete with an undertaking by the patent assertion entity that it will not sue GNOME for IP infringement again. From a report: In a so-called "walk away" settlement, Rothschild Patent Imaging (RPI) and the open-source body are discontinuing their legal battle that began in October last year. RPI sued for alleged IP infringement of one of its patents by the GNOME photo-organising tool Shotwell, marking the first time a free software project had been targeted in that way. In a statement at the time, the GNOME Foundation said RPI "offered to let us settle for a high five-figure amount, for which they would drop the case", something it said would be "wrong" to do. The open-sourcers thus countersued RPI, aided by lawyers from New York law firm Shearman Sterling who agreed to work on the case for free. Neil McGovern, exec director of the foundation, said in a canned statement today: "I'm exceptionally pleased that we have concluded this case. This will allow us to refocus our attention on creating a free software desktop, and will ensure certainty for all free and open source software in future." GNOME Foundation executive director Neil McGovern has told The Register: "For those asking about payment, I can confirm we paid RPI and Leigh Rothschild a grand total of $0.00 for the settlement."

World Health Leaders Stress Need For Sharing of Vaccines (theguardian.com) 127

Long-time Slashdot reader tomtermite shares a report from The Guardian: Ministers and officials from every nation will meet via video link on Monday for the annual world health assembly, which is expected to be dominated by efforts to stop rich countries monopolising drugs and future vaccines against Covid-19... The leaders of Italy, France, Germany and Norway, together with the European commission and council, called earlier this month for any innovative tools, therapeutics or vaccines to be shared equally and fairly.

"If we can develop a vaccine that is produced by the world, for the whole world, this will be a unique global public good of the 21st century," they said in a statement.

The sole resolution before the assembly this year is an EU proposal for a voluntary patent pool. Drug and vaccine companies would then be under pressure to give up the monopoly that patents allow them on their inventions, which means they can charge high prices, so that all countries can make or buy affordable versions. In the weeks of negotiations leading up to the meeting, which is scheduled to last for less than a day, there has been a dispute over the language of the resolution. Countries with major pharmaceutical companies argue they need patents to guarantee sufficiently high prices in wealthy nations to recoup their research and development costs....

Oxfam's health policy manager, Anna Marriott, said: "This week's letter calling for a people's vaccine, which was signed by more than 140 world leaders and experts, sets the bar for the scale of ambition we need to meet the challenge before us...." [Research charity] Wellcome published a poll on Sunday of 2,000 people in the UK which found 96% supported the idea that national governments should work together to ensure that treatments and vaccines can be manufactured in as many countries as possible and distributed globally to everyone who needs them.

"We need vaccines and treatments that will work for the world, and any advances must be available to all countries equally, without exception," said Alex Harris, the head of global policy at Wellcome.

WordLogic offered a "discounted, lump sum fee of $30,000 in exchange for a paid-up one-time license," an easy win they thought, but Wikimedia fought back. "Wikimedia notes that (1) WordLogic's patents are invalid due to prior art, (2) that they are invalid for not covering patentable subject matter, and (3) that anyway, it doesn't even infringe on the patents if they were valid," reports Techdirt. Now we are waiting to see what will happen. Will the patent troll desist, or will it push forward?

AI Cannot Be Inventors, US Patent Office Rules (vice.com) 59

On Monday, the United States Patent and Trademark Office published a decision that claims artificial intelligences cannot be inventors. Only "natural persons" currently have the right to get a patent. From a report: Last year, two relatively mundane patents -- one for a shape-shifting food container and another for an emergency flashlight -- posed an existential question for international patent regulations around the world: Does an inventor have to be a human? These two inventions were the work of DABUS, an artificial intelligence system created by physicist and AI researcher Stephen Thaler. Now, the USPTO has decided that DABUS and any other AI cannot be listed as an inventor on a patent filing. Until now, US patent law was vague about whether machines could invent, referring to "individuals" as eligible inventors. Thaler, along with a group of patent law experts, argued that because Thaler didn't have any expertise in containers or flashlights, and didn't help DABUS make the inventions, it wouldn't be right for him to be listed as the inventor.

People Are Open-Sourcing Their Patents and Research To Fight Coronavirus (vice.com) 17

An anonymous reader quotes a report from Motherboard: A global group of scientists and lawyers announced their efforts to make their intellectual property free for use by others working on coronavirus pandemic relief efforts -- and urged others to do the same -- as part of the "Open Covid Pledge." Mozilla, Creative Commons, and Intel are among the founding members of this effort; Intel contributed to the pledge by opening up its portfolio of over 72,000 patents, according to a press release. Participants are asked to publicly take the pledge by announcing it on their own websites and issuing a press release.

"Immediate action is required to halt the COVID-19 Pandemic and treat those it has affected," the pledge states. "It is a practical and moral imperative that every tool we have at our disposal be applied to develop and deploy technologies on a massive scale without impediment. We therefore pledge to make our intellectual property available free of charge for use in ending the COVID-19 pandemic and minimizing the impact of the disease." From there, people and companies are asked to adopt a license detailing the terms and conditions their intellectual property will be available; while pledgers are permitted to write their own license based on their needs, the organizers wrote "Open COVID License 1.0" as a template for immediate use, which grants usage rights to anyone working toward "minimizing the impact of the disease, including without limitation the diagnosis, prevention, containment, and treatment of the COVID-19 Pandemic." The license is effective until one year after the World Health Organization declares the pandemic to be over.

In a First, China Knocks US From Top Spot in Global Patent Race (reuters.com) 55

China was the biggest source of applications for international patents in the world last year, pushing the United States out of the top spot it has held since the global system was set up more than 40 years ago, the U.N. patent agency said on Tuesday. From a report: The World Intellectual Property Organization, which oversees a system for countries to share recognition of patents, said 58,990 applications were filed from China last year, beating out the United States which filed 57,840. China's figure was a 200-fold increase in just 20 years, it said. The United States had filed the most applications in the world every year since the Patent Cooperation Treaty system was set up in 1978. More than half of patent applications -- 52.4 % -- now come from Asia, with Japan ranking third, followed by Germany and South Korea. [...] According to the WIPO data, China's Huawei, the world's biggest maker of telecoms equipment, was the top corporate patent filer for the third consecutive year.

A global arms race for a coronavirus vaccine is underway. The New York Times reports: In the three months since the virus began its deadly spread, China, Europe and the United States have all set off at a sprint to become the first to produce a vaccine. But while there is cooperation on many levels -- including among companies that are ordinarily fierce competitors -- hanging over the effort is the shadow of a nationalistic approach that could give the winner the chance to favor its own population and potentially gain the upper hand in dealing with the economic and geostrategic fallout from the crisis. What began as a question of who would get the scientific accolades, the patents and ultimately the revenues from a successful vaccine is suddenly a broader issue of urgent national security. And behind the scramble is a harsh reality: Any new vaccine that proves potent against the coronavirus -- clinical trials are underway in the United States, China and Europe already -- is sure to be in short supply as governments try to ensure that their own people are the first in line.

In China, 1,000 scientists are at work on a vaccine, and the issue has already been militarized: Researchers affiliated with the Academy of Military Medical Sciences have developed what is considered the nation's front-runner candidate for success and is recruiting volunteers for clinical trials. China "will not be slower than other countries," Wang Junzhi, a biological products quality control expert with the Chinese Academy of Sciences, said Tuesday at a news conference in Beijing. The effort has taken on propaganda qualities. Already, a widely circulated photograph of Chen Wei, a virologist in the People's Liberation Army, receiving an injection of what was advertised to be the first vaccine, has been exposed as a fake, taken before a trip she made to Wuhan, where the virus began. President Trump has talked in meetings with pharmaceutical executives about making sure a vaccine is produced on American soil, to assure the United States controls its supplies. German government officials said they believed he tried to lure a German company, CureVac, to do its research and production, if it comes to that, in the United States.

Oh, and also Irell & Manella, the same law firm that once claimed it could represent a monkey in a copyright infringement dispute. You see, Irell & Manella has now filed one of the most utterly bullshit patent infringement lawsuits you'll ever see. They are representing "Labrador Diagnostics LLC" a patent troll which does not seem to exist other than to file this lawsuit, and which claims to hold the rights to two patents (US Patents 8,283,155 and 10,533,994) which, you'll note, were originally granted to Elizabeth Holmes and Theranos -- the firm that shut down in scandal over medical testing equipment that appears to have been oversold and never actually worked. Holmes is still facing federal charges of wire fraud over the whole Theranos debacle. However, back in 2018, the remains of Theranos sold its patents to Fortress Investment Group. Fortress Investment Group is a SoftBank-funded massive patent troll. You may remember the name from the time last fall when Apple and Intel sued the firm, laying out how Fortress is a sort of uber-patent troll, gathering up a bunch of patents and then shaking down basically everyone. Lovely, right? So, this SoftBank-owned patent troll, Fortress, bought up Theranos patents, and then set up this shell company, "Labrador Diagnostics," which decided that right in the midst of the Covid-19 pandemic it was going to sue one of the companies making Covid-19 tests, saying that its test violates those Theranos patents, and literally demanding that the court bar the firm from making those Covid-19 tests.

IBM is taking Airbnb to court over what it claims is the illegal use of four patents -- the latest in a string of suits against online companies involving historic and arguably broad innovations -- in a move that threatens to cast a shadow over the short-term rental company's road to a proposed IPO. From a report: The computing giant has accused Airbnb of "building its business" by using patents relating to functions such as "presenting advertising in an interactive service" and "improved navigation using bookmarks." "After almost six years of unsuccessful discussions with Airbnb to reach a fair and reasonable patent licence agreement, we had no alternative but to file legal action to protect our intellectual property rights," IBM said. "Airbnb has chosen to ignore our patents and use our technology without compensation."

The New York Times reports: Some of Earth's plants have fallen in love with metal. With roots that act practically like magnets, these organisms -- about 700 are known -- flourish in metal-rich soils that make hundreds of thousands of other plant species flee or die....

The plants not only collect the soil's minerals into their bodies but seem to hoard them to "ridiculous" levels, said Alan Baker, a visiting botany professor at the University of Melbourne who has researched the relationship between plants and their soils since the 1970s. This vegetation could be the world's most efficient, solar-powered mineral smelters. What if, as a partial substitute to traditional, energy-intensive and environmentally costly mining and smelting, the world harvested nickel plants...?

On a plot of land rented from a rural village on the Malaysian side of the island of Borneo, Dr. Baker and an international team of colleagues have proved it at small scale. Every six to 12 months, a farmer shaves off one foot of growth from these nickel-hyper-accumulating plants and either burns or squeezes the metal out. After a short purification, farmers could hold in their hands roughly 500 pounds of nickel citrate, potentially worth thousands of dollars on international markets. Now, as the team scales up to the world's largest trial at nearly 50 acres, their target audience is industry. In a decade, the researchers hope that a sizable portion of insatiable consumer demand for base metals and rare minerals could be filled by the same kind of farming that produces the world's coconuts and coffee... [T]he technology has the additional value of enabling areas with toxic soils to be made productive...

Now, after decades behind the lock and key of patents, Dr. Baker said, "the brakes are off the system."

IBM and Microsoft Sign Vatican Pledge For Ethical AI (ft.com) 93

IBM and Microsoft have signed an "ethical resolution" with the Vatican to develop AI in a way that will protect the planet and the rights of all people [Editor's note: the link may be paywalled; alternative source]. From a report: The pledge, called the "Rome Call for AI Ethics," will be presented on Friday morning to Pope Francis by Brad Smith, the president of Microsoft, and John Kelly, IBM's executive vice-president, as well as Vatican officials and Qu Dongyu, the Chinese director-general of the UN Food and Agriculture Organization. The two US tech companies lead the world in AI development, measured by the number of patents they have amassed. The document calls for AI to safeguard the rights of all humankind, particularly the weak and underprivileged, and for new regulations in fields such as facial recognition. It said that there must be a "duty of explanation" that would show not only how AI algorithms come to their decisions but also what their purpose and objectives are.

Supreme Court Rejects Apple Appeal In Patent Fight With VirnetX (reuters.com) 35

New submitter John Trumpian shares a report from Reuters: The U.S. Supreme Court on Monday refused to hear Apple's bid to avoid paying about $440 million in damages for using patent licensing firm VirnetX's internet security technology without permission in features such as FaceTime video calling. The justices rejected Apple's appeal in the long-running case in which a federal jury in 2016 found that Apple had infringed VirnetX's patents and awarded $302 million. A judge later increased that amount to $439.7 million including interest and other costs.

The case dates back to 2010 when Nevada-based VirnetX filed suit in federal court in the Eastern District of Texas accusing Cupertino, California-based Apple of infringing four patents for secure networks, known as virtual private networks, and secure communications links. VirnetX said Apple infringed with its FaceTime and VPN on Demand features in products such as the iPhone and iPad. The U.S. Court of Appeals for the Federal Circuit in Washington, which specializes in patent disputes, upheld the judgment against Apple last year.

Hydro-Quebec To Commercialize Glass Battery Co-Developed By John Goodenough (ieee.org) 42

An anonymous reader quotes a report from IEEE Spectrum: A rapid-charging and non-flammable battery developed in part by 2019 Nobel Prize winner John Goodenough has been licensed for development by the Canadian electric utility Hydro-Quebec. The utility says it hopes to have the technology ready for one or more commercial partners in two years. Hydro-Quebec, according to Karim Zaghib, general director of the utility's Center of Excellence in Transportation Electrification and Energy Storage, has been commercializing patents with Goodenough's parent institution, the University of Texas at Austin, for the past 25 years.

As Spectrum reported in 2017, Goodenough and Maria Helena Braga, professor of engineering at the University of Porto in Portugal, developed a solid-state lithium rechargeable that used a glass doped with alkali metals as the battery's electrolyte. (The electrolyte is the material between cathode and anode and is often a liquid in today's batteries, which typically means it's also flammable and potentially vulnerable to battery fires.) Braga said her and Goodenough's battery is high capacity, charges in "minutes rather than hours," performs well in both hot and cold weather, and that its solid-state electrolyte is not flammable.
Hydro-Quebec's Gen 3 battery "can be glass or ceramic, but it is not a [lithium] polymer," Zaghib said of the Goodenough/Braga battery's electrolyte. "So with Daimler (which is also working with Hydro-Quebec to develop a second-gen lithium solid-state battery), it's an organic compound, and with John Goodenough, it's an inorganic compound. The inorganic compound has higher ionic conductivity compared to the polymer."

"That means the ions shuttle back and forth more readily between cathode and anode, which could potentially improve a battery's capacity, charging speed, or other performance metrics," adds IEEE Spectrum.

Nonprofit Argues Germany Can't Ratify the 'Unitary Patent' Because of Brexit (ffii.org) 64

Long-time Slashdot reader zoobab shares this update from the Foundation for a Free Information Infrastructure, a Munich-based non-profit opposing ratification of a "Unified Patent Court" by Germany. They argue such a court will "validate and expand software patents in Europe," and they've come up with a novel argument to stop it.

"Germany cannot ratify the current Unitary Patent due to Brexit..." The U.K. is now a "third state" within the meaning of AETR case-law, [which] makes clear that:

"Each time the Community, with a view to implementing a common policy envisaged by the Treaty, adopts provisions laying down common rules, whatever form they may take, the Member States no longer have the right, acting individually or even collectively, to undertake obligations with third countries which affect those rules or alter their scope..."

This practically means that the ratification procedure for the Agreement on the Unified Patent Court must now come to an end, as that Agreement no longer applies due to the current significant changes (i.e. Brexit) in the membership requirements of its own ratification rules.

The nonprofit also argues that the Unitary Patent "is a highly controversial and extreme issue, as it allows new international patent courts to have the last word on the development and application of patent law and industrial property monopolies including, more seriously, the validation and expansion of software patents, that is the key sector on which whole industries and markets depend."

Radical Hydrogen-Boron Reactor Leapfrogs Current Nuclear Fusion Tech (newatlas.com) 185

HB11 Energy, a spin-out company originating at the University of New South Wales, claims its hydrogen-boron fusion technology is already working a billion times better than expected. Along with this announcement, the company also announced a swag of patents through Japan, China and the USA protecting its unique approach to fusion energy generation. New Atlas reports: The results of decades of research by Emeritus Professor Heinrich Hora, HB11's approach to fusion does away with rare, radioactive and difficult fuels like tritium altogether -- as well as those incredibly high temperatures. Instead, it uses plentiful hydrogen and boron B-11, employing the precise application of some very special lasers to start the fusion reaction. Here's how HB11 describes its "deceptively simple" approach: the design is "a largely empty metal sphere, where a modestly sized HB11 fuel pellet is held in the center, with apertures on different sides for the two lasers. One laser establishes the magnetic containment field for the plasma and the second laser triggers the 'avalanche' fusion chain reaction. The alpha particles generated by the reaction would create an electrical flow that can be channeled almost directly into an existing power grid with no need for a heat exchanger or steam turbine generator."

HB11's Managing Director Dr. Warren McKenzie clarifies over the phone: "A lot of fusion experiments are using the lasers to heat things up to crazy temperatures -- we're not. We're using the laser to massively accelerate the hydrogen through the boron sample using non-linear forced. You could say we're using the hydrogen as a dart, and hoping to hit a boron , and if we hit one, we can start a fusion reaction. That's the essence of it. If you've got a scientific appreciation of temperature, it's essentially the speed of atoms moving around. Creating fusion using temperature is essentially randomly moving atoms around, and hoping they'll hit one another, our approach is much more precise." He continues: "The hydrogen/boron fusion creates a couple of helium atoms. They're naked heliums, they don't have electrons, so they have a positive charge. We just have to collect that charge. Essentially, the lack of electrons is a product of the reaction and it directly creates the current."

The lasers themselves rely upon cutting-edge "Chirped Pulse Amplification" technology, the development of which won its inventors the 2018 Nobel prize in Physics. Much smaller and simpler than any of the high-temperature fusion generators, HB11 says its generators would be compact, clean and safe enough to build in urban environments. There's no nuclear waste involved, no superheated steam, and no chance of a meltdown. "This is brand new," Professor Hora tells us. "10-petawatt power laser pulses. It's been shown that you can create fusion conditions without hundreds of millions of degrees. This is completely new knowledge. I've been working on how to accomplish this for more than 40 years. It's a unique result. Now we have to convince the fusion people -- it works better than the present day hundred million degree thermal equilibrium generators. We have something new at hand to make a drastic change in the whole situation. A substitute for carbon as our energy source. A radical new situation and a new hope for energy and the climate."

Gopher's Rise and Fall Shows How Much We Lost When Monopolists Stole the Net (eff.org) 69

Science-fiction writer, journalist and longtime Slashdot reader, Cory Doctorow, a.k.a. mouthbeef, writes: The Electronic Frontier Foundation (EFF) just published the latest installment in my case histories of "adversarial interoperability" -- once the main force that kept tech competitive. Today, I tell the story of Gopher, the web's immediate predecessor, which burrowed under the mainframe systems' guardians and created a menu-driven interface to campus resources, then the whole internet. Gopher ruled until browser vendors swallowed Gopherspace whole, incorporating it by turning gopher:// into a way to access anything on any Gopher server. Gopher served as the booster rocket that helped the web attain a stable orbit. But the tools that Gopher used to crack open the silos, and the moves that the web pulled to crack open Gopher, are radioactively illegal today.

If you wanted do to Facebook what Gopher did to the mainframes, you would be pulverized by the relentless grinding of software patents, terms of service, anticircumvention law, bullshit theories about APIs being copyrightable. Big Tech blames "network effects" for its monopolies -- but that's a counsel of despair. If impersonal forces (and not anticompetitive bullying) are what keeps tech big then there's no point in trying to make it small. Big Tech's critics swallow this line, demanding that Big Tech be given state-like duties to police user conduct -- duties that require billions and total control to perform, guaranteeing tech monopolists perpetual dominance. But the lesson of Gopher is that adversarial interoperability is judo for network effects.

'Project Magnum': Flywheel's Alleged Plot To Steal Peloton's Technology (vice.com) 77

em1ly writes: Spin bike maker Flywheel lost a patent lawsuit to rival company Peloton, announcing yesterday that it's shutting down. Motherboard uncovered some wild corporate espionage in the court documents: "At some point before the launch of FLY Anywhere, according to Peloton's lawyers, Flywheel launched 'Project Magnum,' an attempt to 'obtain as MUCH secret intel on Peloton as we can,' according to an improperly redacted document Peloton filed in court. 'Project Magnum was not some extemporaneous side-project [...] but rather a concerted, widespread effort,' one of Peloton's filings adds.

But Project Magnum was, apparently, more haphazard than spy operation. Flywheel created a Google Doc to 'create tabs with the functional areas of info so that the team know[s] to keep adding to it,' one of the documents reads. Much of the conspiracy seems to have taken place over email, judging by discovery that Peloton obtained. Someone at Flywheel named the project after the Magnum PI television series, one of the court documents adds, although the filing does not include the individual's name. The filings do not go into detail on how Flywheel apparently tried to obtain Peloton's secrets, but they do include contours of the project. In a message seemingly written by a former Flywheel CTO who now works at Facebook, he wrote 'Villency could be useful in providing insight related to Project Magnum.' Eric Villency, and his company Villency Design Group, designed the Peloton and SoulCycle stationary bikes..."

Joint Photographic Experts Group (JPEG), a committee that maintains various JPEG image-related standards, has started exploring a way to involve AI to build a new compression standard. From a report: In a recent meeting held in Sydney, the group released a call for evidence to explore AI-based methods to find a new image compression codec. The program, aptly named JPEG AI, was launched last year; with a special group to study neural-network-based image codecs. Under the program, it aims to find possible solutions towards finding a new standard. To do that, it has partnered with IEEE (Institute of Electrical and Electronics Engineers) to call for papers under the Learning-based Image Coding Challenge. These papers will be presented at the International Conference of Image Processing (ICIP) scheduled to be held at Abu Dhabi in October.
