According to one World Bank executive, it could have already happened, 'and we don't know about it.' While the IRS does offer data encryption to its workers, more than half of its 94,000 employees have permission to take taxpayer information to locations outside the IRS offices. In the 2007 filing season, roughly 128 million individual tax returns were filed. In addition to the basic personal information on those forms, an IRS breach could also jeopardize the banking information of the 46% of filers who requested direct deposit refunds. This is not the first time that IRS security has been called into question, and the Department of Treasury's progress in that arena is dubious. [PDF]"

anthrax writes "Ignoring Congressional and public comments, the FCC voted to relax ownership rules that have prevented broadcasters from owning newspapers in the nation's 20 largest media markets. After holding several public hearings that overwhelmingly opposed the relaxation of the rules, and Congressional hearing where Democrats and Republicans (even Ted 'Tubes' Stevens) voiced opposition to the move, the FCC voted 3 to 2 to relax ownership. On the same day the FCC voted 3 to 2 (by a different split) to cap the size of any cable company at 30% of the nationwide market, a limit Comcast is up against."

James Hardine writes "Wired is reporting that a never-before-seen military manual detailing the day-to-day operations of the U.S. military's Guantánamo Bay detention facility has been leaked to the web, via the whistle-blowing site Wikileaks.org, affording a rare inside glimpse into the institution where the United States has imprisoned hundreds of suspected terrorists since 2002. The 238-page document, "Camp Delta Standard Operating Procedures," is dated March 28, 2003. The disclosure highlights the internet's usefulness to whistle-blowers in anonymously propagating documents the government and others would rather conceal. The Pentagon has been resisting — since October 2003 — a Freedom of Information Act request from the American Civil Liberties Union seeking the very same document. Anonymous open-government activists created Wikileaks in January, hoping to turn it into a clearinghouse for such disclosures. The site uses a Wikipedia-like system to enlist the public in authenticating and analyzing the documents it publishes. The Camp Delta document includes schematics of the camp, detailed checklists of what "comfort items" such as extra toilet paper can be given to detainees as rewards, six pages of instructions on how to process new detainees, instructions on how to psychologically manipulate prisoners, and rules for dealing with hunger strikes."

cleetus writes "Today Senator Chris Dodd decided to put a hold on the FISA bill, one of the provisions of which would have granted immunity to any telecom which, if found to have acted in good faith, violated U.S. laws in turning over customer data to the government. According to TPM Election Central, "By doing this, Dodd can effectively hold up the telecom immunity bill, because bills are supposed to have unanimous consent in the Senate before going forward. One Senator can make it very difficult to bring a bill to the floor by objecting to allowing it to go to a vote." This throws a fairly big roadblock in front of this bill, covered by Slashdot earlier today."

EllisDees sends in a Washington Post report that Senate Republicans have outmaneuvered Democrats, who withdrew a more stringent version of legislation to control the government's domestic surveillance program. The legislation that will go forward includes a grant of legal immunity to telecommunications companies that have assisted the program.

Talen317 writes with news that the US House of Representatives has voted overwhelmingly to renew the ban on taxing Internet access — but only for 4 years, not permanently. A majority of House members (238) co-signed the bill to make the moratorium permanent. Republicans blamed the House leadership for refusing to bring this latter bill to a vote, charging that the Democrats wanted to leave the door open for future taxation. Not so, countered Rep. Mel Watt (D-N.C.), one of the sponsors of the 4-year bill. The Senate must act on the moratorium before Nov. 1 if taxation is to be avoided, and Watt claimed that a permanent ban would be dead on arrival in the Senate.

This new study finds that the differences are apparent even when the brain processes common information, not just political topics. From the study, liberals were more likely to be accurate and showed more brain activity in the region associated with analyzing conflicts. A researcher not affiliated with the study stated, liberals 'could be expected to more readily accept new social, scientific or religious ideas.' Moreover, 'the results could explain why President Bush demonstrated a single-minded commitment to the Iraq war and why some people perceived Sen. John F. Kerry... as a flip-flopper.'"

quizzicus writes "The Washington Post writes today about a sensitive White House document detailing how to screen for, silence, and remove protesters who show up at the President's public appearances. Obtained by an ACLU subpoena in the Rank v. Jenkins case, the Presidential Advance Manual (PDF) is dated October 2002. It lays out strategies such as searching audience members at the door for hidden protest material, strategically placing 'rally squads' throughout the crowd to intercept and shout down hecklers, and forcefully removing dissenters who cannot be squelched. The manual advises, however, that staff should 'decide if the solution would cause more negative publicity than if the demonstrators were simply left alone.'"

Boggs, where the defendant interposed a counterclaim alleging that the RIAA's $750-per-song file damages theory is unconstitutional, and the RIAA moved to dismiss the counterclaim, the US Department of Justice has sought and obtained an extension of time in which to decide whether to intervene in the case on the side of the RIAA. What probably precipitated the issue is that the constitutional question was raised not just as a defense as it was in UMG v. Lindor, but as a counterclaim, thus prompting a dismissal motion by the RIAA."

A while back we discussed the corruption investigation aimed at Alaska Sen. Ted "series of tubes" Stevens. A number of readers sent us word that the home of Sen. Stevens was raided earlier today by agents of the FBI and the IRS. The focus of the raid was a remodeling project at Stevens's home and the involvement of VECO, an oil company.

A couple of weeks back we discussed the effort to require voting paper trails in US federal elections. Now WhiteBoxVoter writes: "Democrats and Republicans in the US House of Representatives agreed today on a compromise that will push through a bill banning paperless voting machines and requiring a voter-verified paper record for every vote in the country, after government sanctioned hackers showed how they could break into all three of the top voting systems used in California." The NYTimes reported on Thursday that even if it passes the House, voting-machine reform that would take effect before the 2008 elections may die in the Senate.

amigoro writes to let us know about the noise a group of scientists is making to call attention to Executive Order 13422, going into effect today, that gives political appointees final say regarding science-based federal agency regulations. The Union of Concerned Scientists wrote a letter to two Senate committee chairs urging that questions about this executive order be asked at the confirmation hearings for the nominee to head the Office of Management and Budget. "UCS urged the Senate committee to ask [the nominee] Mr. Nussle how he would ensure that political appointees would not interfere with the work of agency scientists." Late last month the House voted to prohibit the Office of Information and Regulatory Affairs from spending federal money on Executive Order 13422. Democrats called the order a "power grab."

DragonTHC writes "Senator Ted Stevens, Republican of Alaska, is being investigated in a federal corruption probe that has implicated his son Ben. Part of the case involves a fishing co-op whose members allegedly paid Ben Stevens $500,000 to get a federal bailout from his father." The other Alaskan senator, also a Republican, is under a cloud as well.

An anonymous reader notes that President Bush has decided to commute Scooter Libby's sentence after numerous appeals failed. Libby was convicted in March of obstruction of justice in connection with the Valerie Plame affair. The President's action spares Libby from 30 months behind bars."

goombah99 writes "John Edwards, the presidential candidate and lawyer, is standing out from the pack by showing himself to be a bit tech savvy. In 2003 he was a guest host on Lawrence Lessig's Blog, giving his view on the imbalance between property right protection and the good of public access. As of this week he has become the first presidential candidate to support 'open source code' for election systems in addition to voter verified paper records. He's even personally using Twitter. 'Currently, software used in election systems remains the proprietary property of vendors. This situation has created a continual problem when anomalous results have been reported and independent experts are denied the ability to review how the systems work. A growing body of critics oppose this privatization of the voting system.'"

Spamicles alerts us to a report just issued (PDF) by the House Committee on Oversight and Government Reform. At least 88 White House officials used Republican National Committee email accounts for government business. The RNC has destroyed at least some of the emails from 51 of those officials. Law requires emails sent by officials to be stored or recorded. There is evidence that White House lawyers and the (current) Attorney General knew of this but did not act to stop it. From the article: "These e-mail accounts were used by White House officials for official purposes, such as communicating with federal agencies about federal appointments and policies... Given the heavy reliance by White House officials on RNC e-mail accounts, the high rank of the White House officials involved, and the large quantity of missing e-mails, the potential violation of the Presidential Records Act may be extensive."

Science data nerds writes "The White House is consistently and persistently claiming that the US is doing better than Europe in reducing greenhouse gas emissions. This is false — their claim is purely based on carefully selecting the only subset of the data that supports this conclusion. When all the data are used, it is plain that European emissions have declined substantially and US emissions have grown substantially. The article, and this linked analysis, debunk the White House claims."

Hylas sends us to Democracy Now for a newscast on the missing emails, an interview with investigative journalist Greg Palast. Here's Palast talking about the fired US attorney from New Mexico, David Iglesias: "Iglesias believes the real reasons for the firings are in what are called the missing emails, emails sent by the [White House political advisor Karl] Rove team using Republican Party campaign computers, which Rove claims can't be retrieved. But not all the missing emails are missing. We have 500 of them. Apparently the Rove team misaddressed their emails, and late one night they all ended up in our inboxes in our offices in New York City." This story has had zero play in the US media; it's been being carried on the BBC.
