An anonymous reader brings news that Net Neutrality legislation is making another comeback. A new bill, sponsored by Rep. John Conyers (D-MI), would make ISPs who fail to provide service in a non-discriminatory manner subject to anti-trust violations. From the NYTimes: "'The bill squarely addresses the issue of the enormous market power of the telephone and cable companies as the providers of 98 percent of the broadband service in the country,' said Gigi Sohn, president of Public Knowledge. But broadband providers and some congressional Republicans have argued that net neutrality legislation isn't necessary. The broadband market is becoming more competitive and net neutrality regulations could hamper investment in broadband networks, some Republicans said during a hearing this week."

Airw0lf writes with a claim that appears too implausible to credit, at first glance: "If anyone remembers 'Fairlight' — one of the great groups on the warez scene, you may be interested to know that one of their leaders, Tony Krvaric, is now the chairman of the San Diego Republican Party." A similar report (on which the TorrentFreak story above draws heavily, and which is cited for the same claim about Krvaric made in the above-linked Wikipedia entry) showed up last week in The Raw Story. According to these reports, Krvaric is the same person known as "strider" in the Warez scene. I called Krvaric seeking comment; though he was unavailable, I hope he chooses to comment by email to help inform any followup coverage. A telephone receptionist at the office of the San Diego Republican Party acknowledged that she knew of the claims, but refused further comment, citing workplace rules. While she would not directly acknowledge or deny the truth of the allegations, she asked me to "remember, these are things that happened more than 20 years ago." Since some people have been penalized quite harshly (and some have been jailed) for the sort of large-scale software piracy that Fairlight enabled, it's interesting that Krvaric has enjoyed instead a meteoric rise in conservative politics.

coondoggie alerts us to a story that is actually a few weeks old now about a network of sonic buoys to listen to right whales, in order to warn ships away from them. On April 10, 22% of the known population of right whales in the world — 79 out of 350 — were gathered at Stellwagen Bank, off of Massachusetts, to feed on a bumper crop of the tiny crustaceans called copepods. The network of smart buoys helps to protect the whales from the roughly 1,500 ships per year that go through this feeding ground on their way to and from Boston.

CNet is running an update to the controversy over giving telecommunications giants such as AT&T immunity from lawsuits involving the assistance they gave the NSA for illegal wiretaps. Republican leaders are circulating a petition which would force a vote on the bill passed by the Senate but not by the House. Democrats are holding out for a version of the FISA bill which opens the telecoms to prosecution. President Bush still intends to veto any such document. "At a wide-ranging House hearing on Wednesday, FBI Director Robert Mueller again urged passage of a bill that includes immunity for phone companies, arguing that 'uncertainty' among the carriers 'affects our ability to get info as fast and as quickly as we would want.' He admitted, however, that he was not aware of any wiretap requests being denied because of Congress' inaction."

Irvu writes "The US House of Representatives is considering HR. 5036, the 'Emergency Assistance for Secure Elections Act of 2008,' as introduced by Representative Rush Holt. The bill is scheduled for a floor vote later today. It would provide for emergency paper ballots, money for the addition of voter verifiable paper ballots to existing systems, and post-election audits. Crucially, the change to paper is opt-in, making it possible for local jurisdictions to govern their own choices. Here are two summaries of the bill. It was reported out of committee with strong bipartisan support. As of this morning the White house has opposed the bill but not threatened a veto, and some previously supportive Republicans have now changed their tune. YouTube has promised a commercial-free zone in the near future to help Congress deal with the problem of hosting campaign videos that were technically breaking the rule of not redirecting constituents to a commercial site. "Within a month, the one and only responder, YouTube, should have its commercial-free zone up and running, Capuano said. Republicans on the commission still fret that with only one such site, the House could be seen as picking winners and losers on the Web. Rep. Tom Price (R-Ga.), another commission member, said the panel's Republicans want to keep the new rules fluid enough to use any future Web site that comes forward with a better plan. 'Technology moves fast. Congress moves slow,' he said."

Pioneer Woman writes "Researchers at Hebrew University in Jerusalem have found a link between a gene called AVPR1a and ruthless behavior. These findings come from an economic exercise called the 'Dictator Game' that allows players to behave selflessly, or like national dictators and 'little Hitlers' found in workplaces the world over. The team decided to look at AVPR1a because it is known to produce receptors in the brain that detect vasopressin, a hormone involved in 'prosocial' behavior. Researchers tested DNA samples from more than 200 student volunteers, before asking the students to play the game that measured their altruism. There was no connection between the participants' gender and their behavior but there was a link to the length of the AVPR1a gene."

mrogers writes "The EFF has uncovered a troubling footnote in a newly declassified Bush Administration memo, which asserts that 'our Office recently [in 2001] concluded that the Fourth Amendment had no application to domestic military operations.' This could mean that the Administration believes the NSA's warrantless wiretapping and data mining programs are not governed by the Constitution, which would cast Administration claims that the programs did not violate the Fourth Amendment in a whole new light — after all, you can't violate a law that doesn't apply. The claimed immunity would also cover other DoD agencies, such as CIFA, which carry out offline surveillance of political groups within the United States."

RonMcMahon writes "Lawyers for the city of New York have subpoenaed the text message records of thousands of people involved in demonstrations at the 2004 Republican National Convention. Tad Hirsch, creator of the TXTmob code that enabled convention demonstrators to transmit messages to thousands of telephones, has been instructed to release the content of messages exchanged on the service and to identify people who sent and received messages. Hirsch argues that release of such information would be a violation of users' First Amendment and privacy rights. 'I think I have a moral responsibility to the people who use my service to protect their privacy,' said Hirsch."

It seems the hard drives of many White House computers are gone beyond the possibility of recovery. Is it unusual in your experience for, say, a corporate IT department to destroy hard drives by policy? "Older White House computer hard drives have been destroyed, the White House disclosed to a federal court Friday in a controversy over millions of possibly missing e-mails from 2003 to 2005. The White House revealed new information about how it handles its computers in an effort to persuade a federal magistrate it would be fruitless to undertake an e-mail recovery plan that the court proposed."

Fletch writes "FCC Chairman Kevin Martin could be in for an uncomfortable spring, as House Energy Committee Chair John Dingel (D-MI) has requested a truckload of FCC paperwork relating to some controversial decisions Martin has made. Those include the FCC's reversal on the a la carte cable issue and newspaper-television cross-ownership restrictions. 'This request has got to be turning the FCC completely upside down. Significantly, it appears to reflect a bipartisan discontent with Martin's performance. Democrats and some Republicans are upset over his recent move to relax one of the agency's key media ownership rules, as well as the rushed manner in which he handled the matter late last year. Other Republicans dislike what they see as Martin's persecution of the cable industry, especially Comcast.' The Committee originally announced its intention to investigate the FCC in January."

freedom_india alerts us to news that the House of Representatives declined to bring the surveillance reform bill to vote, prompting House Republicans to walk out in the middle of a session. The bill, recently passed by the Senate, includes retroactive immunity for the telecommunications companies who assisted with illegal domestic wiretaps. The walk-out comes after a proposal was shot down on Wednesday that would have extended the current legislation for another three weeks.

Following the so called Super Tuesday primary mega bash yesterday, McCain has solidified a strong lead in the primary race over his rival Republicans. Things aren't so clear for the Democrats: while Clinton leads, the race is still too close to call.

Mississippi legislators have introduced a bill that would make it illegal for state licensed restaurants to serve obese patrons. The work of Republicans W. T. Mayhall Jr., John Read, and Democrat Bobby Shows, the bill proposes that the state's Department of Health establish weight criteria after consultation with Mississippi's Council on Obesity. Some in the Mississippi legislature worry that the new law would be too draconian in nature, not making allowances for the chunky, thick, husky or big boned.
